This is an agreement between you (“you”) and HED Unity Ltd. (together with its Affiliates, “HED Unity”, “we”, “us” or “our”) which governs the terms of this promotional website (the “Website”). Once Unity hits the market, we will expand this Website and will provide additional terms relevant to our expanded offerings.

HED UNITY DOES NOT WARRANT THAT THIS WEBSITE WILL OPERATE WITHOUT INTERRUPTION OR WILL BE ERROR-FREE, OR THAT ALL ERRORS AND OR DEFECTS MAY BE CORRECTED, OR THAT THIS WEBSITE WILL MEET YOUR REQUIREMENTS; THAT ANY FEATURES, FUNCTIONS OR SERVICE DESCRIBED HEREIN WILL CONTINUE TO BE MADE AVAILABLE, THAT THE PRODUCTS WILL BE COMPATIBLE OR WORK WITH ANY THIRD PARTY SOFTWARE, APPLICATIONS OR THIRD PARTY SERVICES.

TO THE MAXIMUM EXTENT ALLOWED UNDER LAW, IN NO EVENT WILL HED UNITY OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR INDIRECT DAMAGES, AND INCLUDING BUT NOT LIMITED TO, COST OF COVER, LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS ARISING FROM THE USE OF (OR INABILITY TO USE) THE PRODUCT, NO MATTER HOW CAUSED AND ON ANY THEORY OF LIABILITY. IN NO EVENT SHALL HED Unity’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES IN ANY ONE OR MORE CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT UNLESS OTHERWISE REQUIRED BY LAW.

These Terms of Service are governed by the laws of the Republic of Ireland without reference to its conflict of law principles. The United Nations Convention on contracts for the International sale of goods is not applicable to this Agreement. Any disputes regarding the Website or these Terms of Service shall be heard exclusively in the courts located in Dublin, Ireland, and you agree to the jurisdiction of those courts for such purposes.

These Terms of Service constitute the entire agreement between you and HED Unity with respect to the subject matter hereof, and supersede all prior oral or written understandings, communications or agreements not specifically incorporated herein. If any provision of these Terms of Service are found to be invalid or unenforceable pursuant to judicial decree or decision, the remainder shall remain valid and enforceable according to its term. Bluetooth, Qobuz, SKYDEX, Soundcloud, and Spotify and any related logos and marks are registered trademarks that are the property of their respective owners (the "Trademarks"). The Trademarks and Unity Marks are protected by U.S. and international laws and are used with the permission of their respective owners.
